Resolution on approval of the rules for the issuance of foreign passports

The Government of the Republic of Tajikistan

On approval of the Rules for the issuance of foreign passports containing electronic data carriers and certificates for return to the Republic of Tajikistan to citizens of the Republic of Tajikistan

In accordance with Article 52 of the Law of the Republic of Tajikistan “On Regulatory Legal Acts” and for the purpose of implementing the Decree of the President of the Republic of Tajikistan of 20 February 2009, No. 624 “On the introduction of foreign passports of citizens of the Republic of Tajikistan containing electronic data carriers”, the Government of the Republic of Tajikistan hereby resolves:

1. To approve the Rules for the issuance of foreign passports containing electronic data carriers and Certificates for return to the Republic of Tajikistan to citizens of the Republic of Tajikistan (attached).

2. To apply these Rules to foreign passports of the Republic of Tajikistan until the full introduction of foreign passports containing electronic data carriers.

3. The Ministry of Foreign Affairs of the Republic of Tajikistan, diplomatic missions and consular institutions of the Republic of Tajikistan abroad, the Ministry of Internal Affairs of the Republic of Tajikistan and its territorial subdivisions shall strictly be guided by these Rules when issuing foreign passports containing electronic data carriers to citizens of the Republic of Tajikistan.

for the issuance of foreign passports containing electronic data carriers and Certificates for return to the Republic of Tajikistan to citizens of the Republic of Tajikistan

1. Principal documents certifying the identity of a citizen of the Republic of Tajikistan abroad

1. Citizens of the Republic of Tajikistan are issued the following documents for travel abroad, permanent residence abroad and return to the Republic of Tajikistan:

- a diplomatic passport, including a diplomatic passport containing electronic data carriers (hereinafter a diplomatic passport);

- a service passport, including a service passport containing electronic data carriers (hereinafter a service passport);

- an ordinary foreign passport, including an ordinary foreign passport containing electronic data carriers (hereinafter an ordinary foreign passport);

- a certificate for return to the Republic of Tajikistan (hereinafter a certificate for return).

2. Authorized state bodies for the issuance of foreign passports, including those containing electronic data carriers

2. The Ministry of Foreign Affairs of the Republic of Tajikistan, diplomatic missions and consular institutions of the Republic of Tajikistan abroad, the Ministry of Internal Affairs of the Republic of Tajikistan and its territorial subdivisions are the authorized state bodies of the Republic of Tajikistan for the issuance of foreign passports.

3. Diplomatic and service passports are issued to civil servants (and to members of their families, in the cases provided for by these Rules) by the Ministry of Foreign Affairs of the Republic of Tajikistan. The categories of civil servants entitled to receive diplomatic and service passports are defined in Annex 1 to these Rules.

4. Diplomatic and service passports must be used for official purposes. For a private trip of a civil servant who holds a diplomatic or service passport, an ordinary foreign passport is issued to him by the authorized state bodies for the issuance of foreign passports.

5. A family member in these Rules means a spouse, children, and adopted children until they reach 23 years of age.

6. Ordinary foreign passports are issued by the Ministry of Foreign Affairs of the Republic of Tajikistan: to civil servants of the Republic of Tajikistan travelling on official foreign assignments; to citizens of the Republic of Tajikistan who are abroad; to citizens travelling to engage in labour activity under intergovernmental agreements; to citizens of the Republic of Tajikistan permanently residing abroad and temporarily staying in the Republic of Tajikistan; and also to employees of legal entities, regardless of the form of ownership, travelling on official assignments.

7. Diplomatic missions and consular institutions of the Republic of Tajikistan abroad issue ordinary foreign passports to citizens of the Republic of Tajikistan who permanently reside or temporarily stay in the receiving country of the diplomatic mission or consular institution or in its consular district.

8. Ordinary foreign passports are issued by the Ministry of Internal Affairs of the Republic of Tajikistan to citizens of the Republic of Tajikistan for travel abroad on private matters, for tourism, for work, recreation, treatment and for permanent residence.

3. Grounds for the issuance of foreign passports of the Republic of Tajikistan

9. Foreign passports of the Republic of Tajikistan are issued by the Ministry of Foreign Affairs of the Republic of Tajikistan on the basis of the following documents:

- an order of the President of the Republic of Tajikistan on the travel abroad of servicemen and employees of law-enforcement bodies of the Republic of Tajikistan; an instruction of the Government and of the Executive Office of the President of the Republic of Tajikistan; a written petition of the leadership of ministries and departments, chairpersons of the Gorno-Badakhshan Autonomous Region, the regions, the city of Dushanbe, districts of republican subordination and other legal entities, regardless of the form of ownership; an application of employees of the central office of the Ministry of Foreign Affairs of the Republic of Tajikistan, diplomatic missions and consular institutions of the Republic of Tajikistan abroad and members of their families;

- an application form signed by a citizen of the Republic of Tajikistan or his legal representative (Annex 2). The application form must be certified by the seal and signature of the head of the petitioning organization. Application forms of employees of the central office of the Ministry of Foreign Affairs of the Republic of Tajikistan, diplomatic missions and consular institutions of the Republic of Tajikistan abroad and members of their families are certified by the signature of their immediate supervisors;

- 4 photographs measuring 3.5×4.5 (the requirements for the photograph are set out in Annex 4);

- the passport of a citizen of the Republic of Tajikistan and a photocopy of the passport;

- receipts for payment of the state duty and other obligatory payments. For the issuance of a diplomatic or service passport, payment is made only by the petitioning organization. When a diplomatic or service passport is issued for family members of civil servants, payment for their issuance may be made either by the petitioning organization or by the civil servant himself;

- a copy of the service identity card or a certificate from the place of work on the position held by the civil servant (for diplomatic and service passports).

10. Civil servants and members of their families who are entitled to receive a diplomatic or service passport complete an application form (Annex 3).

11. Application forms are completed on a typewriter, by computer means or by hand, legibly, in block capital letters. The information indicated in the application form must be clear and exhaustive. In the event of the provision of false information, the applicant bears responsibility in accordance with the legislation of the Republic of Tajikistan.

12. Ordinary foreign passports are issued by diplomatic missions and consular institutions of the Republic of Tajikistan abroad on the basis of:

- an application form signed by a citizen of the Republic of Tajikistan or his legal representative upon presentation of documents confirming his rights (Annex 2);

- 4 photographs measuring 3.5×4.5 (the requirements for the photograph are set out in Annex 4);

- the passport of a citizen of the Republic of Tajikistan and a photocopy thereof, or a foreign passport and a photocopy thereof;

- a receipt for payment of the consular fee. At diplomatic missions and consular institutions of the Republic of Tajikistan abroad, only the consular fee is charged.

13. When issuing foreign passports, diplomatic missions and consular institutions of the Republic of Tajikistan abroad are obliged to ascertain that the applicant belongs to the citizenship of the Republic of Tajikistan and that he does not hold the citizenship of another State. The issuance of a foreign passport is refused if the applicant belongs to the citizenship of another State, unless otherwise provided by international legal instruments recognized by the Republic of Tajikistan.

14. In the event of technical difficulties in the issuance of foreign passports, diplomatic missions and consular institutions of the Republic of Tajikistan abroad have the right to petition for the issuance of a foreign passport at the Ministry of Foreign Affairs of the Republic of Tajikistan or to extend them in accordance with the provisions of Section 5 of these Rules. The procedure for the submission of petitions for the issuance of foreign passports is established by the Ministry of Foreign Affairs of the Republic of Tajikistan.

15. Foreign passports of the Republic of Tajikistan are issued by the Ministry of Internal Affairs of the Republic of Tajikistan on the basis of the following documents:

- a written petition of firms engaged in tourism, an application of citizens of the Republic of Tajikistan or a petition of their legal representatives upon presentation of documents confirming their rights;

- an application form signed by a citizen of the Republic of Tajikistan or his legal representative (Annex 2). Application forms of citizens of the Republic of Tajikistan who are engaged in labour activity or who are studying at educational institutions are certified by the signature and seal of the head of the organization;

- 4 photographs measuring 3.5×4.5 (the requirements for the photograph are in Annex 4);

- the passport of a citizen of the Republic of Tajikistan and a photocopy thereof;

- a military identity card or a draft registration certificate (for citizens aged from 18 to 27 years);

- receipts for payment of the state duty and other fees;

16. When considering a petition for the issuance of a foreign passport to a minor citizen under 16 years of age, it is necessary to present his birth certificate. In the event of disputed questions concerning belonging to the citizenship of the Republic of Tajikistan, a birth certificate with a stamp of the child’s belonging to the citizenship of the Republic of Tajikistan is presented.

17. A passport is issued to a minor citizen from the day of his birth until he reaches 16 years of age on the basis of an application form completed for one of the parents or the legal representative upon presentation of documents confirming his rights.

18. The issuance of a foreign passport to a minor citizen under 18 years of age, in the event of independent travel, is carried out on the basis of the presentation of a notarially certified consent of the parents or legal representatives, or a document confirming the absence of the second parent (a death certificate, a court decision on deprivation of parental rights, a court decision on recognition as missing, etc.).

4. Procedure for the issuance, delivery and exchange of foreign passports

19. After the acceptance of documents in accordance with the requirements of Section 3 of these Rules and the conduct of the necessary checks, the authorized state body issues a foreign passport to the citizen of the Republic of Tajikistan.

20. Foreign passports of citizens of the Republic of Tajikistan are completed in Cyrillic (in the Tajik language) and in Latin letters (in the English language).

21. A foreign passport is issued on the basis of the information recorded in the passport of a citizen of the Republic of Tajikistan. A foreign passport of a minor citizen is issued on the basis of the information recorded in the child’s birth certificate.

22. On page 32 of the foreign passport are entered the surname (the first box from the top), given name (the second box from the top) and patronymic (the third box from the top) of the applicant, in Cyrillic in the Tajik language. The boxes “номи хонаводагӣ surname” and “ном given name” must be completed on a mandatory basis.

23. On the inside of the back cover of the foreign passport a photograph measuring 3.5×4.5 of the established specimen is affixed, which is sealed with the stamp of the authorized state body for the issuance of foreign passports. This page is completed in Latin letters (in the English language).

24. In the box “рақами шиноснома passport No” the series and number of the foreign passport are entered, corresponding to the letter and digits perforated through all internal pages of the foreign passport.

25. In the boxes “номи хонаводагӣ” and “ном” the surname and given name of the applicant are entered, the transliteration of which into Latin letters is performed by a computer programme. If, when the computer programme transliterates the given name or surname of the applicant, an incorrect letter is indicated, the authorized state body may, on the basis of a reasoned application of the applicant, change his given name or surname only in Latin letters. In this case, the applicant is obliged to write this information in the application form.

26. In the box “шаҳрвандӣ nationality” the word “Tajikistan” is entered in Latin letters.

27. In the boxes “таърихи таваллуд Date of birth”, “таърихи судур date of issue”, “таърихи ниҳояти эътибор date of expire” the date and year are written in digits, and the month is written in words in Latin letters.

28. In the box “ҷинс sex” the sex of the citizen is entered in English: “F” (female), “M” (male).

29. In the box “ҷои таваллуд place of birth” the name of the State in which the citizen of the Republic of Tajikistan was born is entered in the English language.

30. In the box “мақоме, ки шиноснома додаст authority” the name of the authorized state body that issued the foreign passport is entered in the English language.

31. The procedure for the issuance of foreign passports containing electronic data carriers is determined by a joint Instruction of the Ministry of Foreign Affairs of the Republic of Tajikistan, the Ministry of Internal Affairs of the Republic of Tajikistan and the State Committee for National Security of the Republic of Tajikistan.

32. Before the expiry of the period of validity of a foreign passport, a foreign passport is exchanged or issued in the following cases:

- upon a change in the official status of the passport holder, when such a change requires the replacement of one type of passport by another type;

- when there are no free pages in the passport for the entry of records, marks and visas;

- in the event of mechanical wear of the passport or its unsuitability for further use;

- in the event of loss of the passport;

- upon a change by the citizen, in the established procedure, of surname, given name or patronymic;

- upon receipt of a second passport.

33. A new foreign passport is issued on condition of the withdrawal of the previously issued foreign passport whose period of validity has not expired.

34. Foreign passports whose period of validity has expired are not withdrawn.

35. If a valid foreign passport of a citizen of the Republic of Tajikistan has no free pages and contains valid visas of foreign States, and the citizen has applied for a new foreign passport, a new passport may, upon the petition of the person, be issued without withdrawal of the old one. In this case, a through punch is made in the previously issued passport in the lower left corner of the holder’s photograph. The issuance of the new foreign passport is carried out in accordance with the requirements of Section 3 of these Rules.

36. In the event of the loss of a foreign passport on the territory of the Republic of Tajikistan, its holder must apply to the authorized state body for the issuance of foreign passports.

37. In the event of the loss of a foreign passport abroad, its holder must immediately apply to the internal affairs bodies of the receiving country, as well as to the consular institution of the Republic of Tajikistan in that country, which immediately reports to the Ministry of Foreign Affairs of the Republic of Tajikistan, indicating the surname, given name and patronymic of the person who lost the foreign passport, the series and number of the foreign passport, the place of its loss (the country), and, if the citizen of the Republic of Tajikistan who lost the foreign passport arrived on an official assignment, indicating the name of the department that sent him abroad.

38. In the event of the loss of a foreign passport and the absence of a consular institution of the Republic of Tajikistan in that country, a citizen of Tajikistan is obliged immediately to report the incident to the internal affairs bodies of the receiving country, and then to a consular institution of the Republic of Tajikistan in the nearest country or to the Ministry of Foreign Affairs of the Republic of Tajikistan for the protection of his rights and interests.

39. The authorized state bodies for the issuance of foreign passports inform the Main Directorate of Border Troops of the State Committee for National Security of the Republic of Tajikistan of the loss of the passport.

40. If a citizen of the Republic of Tajikistan has lost a previously issued foreign passport whose period of validity has not expired, a new foreign passport is issued only on condition of official notification of the relevant bodies of the Republic of Tajikistan of the loss of the previous foreign passport.

41. In the Republic of Tajikistan, found passports, as well as passports of deceased citizens of the Republic of Tajikistan, are surrendered to the authorized state bodies for the issuance of foreign passports. Abroad, such documents are surrendered to diplomatic missions or consular institutions of the Republic of Tajikistan for subsequent transmission to the authorized state bodies for the issuance of foreign passports in the Republic of Tajikistan.

42. The authorized state body for the issuance of foreign passports decides on the return of the foreign passport to the holder or on its destruction. If a decision is taken to return the passport to its holder, the authorized state body for the issuance of foreign passports transmits this information to the Main Directorate of Border Troops of the State Committee for National Security of the Republic of Tajikistan for use in official activity.

43. Foreign passports not issued to citizens during their period of validity are destroyed in the established procedure.

44. In the event of the loss of a foreign passport abroad, a certificate for return is issued to the citizen for return to the Republic of Tajikistan.

45. If the activity of a citizen of the Republic of Tajikistan is connected with regular (more than twice a month) trips outside the Republic of Tajikistan, a second foreign passport may be issued to him, with the period of validity of the first foreign passport.

46. To confirm frequent trips, the applicant must present the valid foreign passport in his possession, attaching copies of the pages of the foreign passport with no fewer than four marks of crossing the State border within two months.

47. The provisions of paragraphs 45 and 46 apply only to ordinary foreign passports.

48. When issuing a passport, the authorized person of the state body must check the correctness of the completion of all particulars of the passport and the resemblance of the citizen to the photograph.

49. If a technical defect is discovered or incorrect information is indicated in the foreign passport, a new passport is issued to the citizen without the submission of additional documents and without the collection of the state duty and other fees.

50. When ordinary foreign passports are issued to citizens permanently residing abroad and to citizens travelling abroad for permanent residence, an ink stamp “for permanent residence” is affixed, and an entry is made as to in replacement of which document the passport is issued, certified by the signature of the authorized person and the seal of the authorized state body for the issuance of foreign passports.

51. Corrections entered in foreign passports must be stipulated in the Tajik and English languages on a free page of the passport, and are certified by the signature of the authorized person and the seal of the authorized state body for the issuance of foreign passports.

52. When receiving an ordinary foreign passport, the presence of the citizen or his legal representative is obligatory. Diplomatic and service passports may be received by authorized employees of the petitioning state institutions.

5. Periods of validity and extension of the periods of validity of foreign passports. Time limits for the consideration of petitions and applications

53. Diplomatic, service and ordinary foreign passports are issued to citizens of the Republic of Tajikistan for a period of 5 years, and ordinary foreign passports containing electronic data carriers for a period of 10 years.

54. Diplomatic passports of deputies of the Majlisi Namoyandagon of the Majlisi Oli of the Republic of Tajikistan, members of the Majlisi Milli of the Majlisi Oli of the Republic of Tajikistan and members of their families are issued for the term of office of the deputies of the Majlisi Namoyandagon of the Majlisi Oli of the Republic of Tajikistan and members of the Majlisi Milli of the Majlisi Oli of the Republic of Tajikistan.

55. In the event of technical difficulties in the issuance of foreign passports or of an urgent trip of a citizen abroad, foreign passports may be extended by the authorized state bodies for the issuance of foreign passports.

56. Ordinary foreign passports are extended for a period of not more than 3 years and only once.

57. Diplomatic and service passports are extended by the Ministry of Foreign Affairs of the Republic of Tajikistan or by diplomatic missions or consular institutions of the Republic of Tajikistan abroad in agreement with the Ministry of Foreign Affairs of the Republic of Tajikistan for a period of not more than one year and only once.

58. When the period of validity of a foreign passport is extended, an ink stamp is affixed on a separate page of the foreign passport, certified by the signature of the authorized person and the seal of the authorized state body for the issuance of foreign passports.

59. The extension of the period of validity of a foreign passport must be effected from the day of expiry of the period of validity of the passport presented for extension.

60. Petitions of natural and legal persons of the Republic of Tajikistan for the issuance of foreign passports are considered within 15 working days. When a foreign passport is issued to a citizen of the Republic of Tajikistan in connection with the need for emergency treatment, a serious illness or the death of a relative residing abroad, the application for the issuance of a foreign passport is considered within three working days without the collection of a fee for urgency. The grounds for urgent consideration of applications for the issuance of a foreign passport are a letter or certificate of a medical organization, or an international telegraph message certified in the appropriate procedure.

61. An application for the issuance of ordinary foreign passports for departure from the Republic of Tajikistan for permanent residence is considered within a period of not more than three months.

62. Applications of citizens for the issuance or extension of the period of validity of foreign passports at diplomatic missions or consular institutions of the Republic of Tajikistan abroad are considered within a period of not more than one month.

63. For urgent consideration (within 7 working days) of applications of natural and legal persons, the amount of the fee is increased by 100%; within 3 working days — by 200%, respectively.

6. Procedure for entering family members in a foreign passport. Removal of family members from a foreign passport

64. Children under 16 years of age may be entered in the passports of their parents or of the persons accompanying them.

65. Children entered in a foreign passport are photographed separately from the parents or the person in whose passport they are entered, regardless of age.

66. On page 30 of the foreign passport a photograph of the child is affixed, which is certified by the seal of the authorized state body for the issuance of foreign passports.

67. On page 31 of the foreign passport the surname, given name and sex of the child are entered in Cyrillic (in the Tajik language) and in Latin letters (in the English language); the day, month and year of birth — in digits. The surname and given name of the child entered in the first line of page 31 must correspond to the photograph of the child affixed in frame 1 of page 30.

68. If it is necessary to make a large number of entries concerning children, a reference to another page of the passport is entered in the lower part of page 31, certified by the seal of the authorized state body: “ниг. ба саҳ… See page…”.

69. Children travelling abroad separately from their parents are entered in the passport of the person accompanying them upon the existence of a notarially certified consent of the parents or their legal representatives. In this case, a photograph of the child is affixed on a blank page of the foreign passport, and the following entry is made in the Tajik and English languages: “(Насаб, ном ва соли таваллуди кӯдак) ба шиносномаи мазкур ворид карда шуд”, “(Name, last name and date of birth of child) included to this passport”. The entry and the photograph are certified by the signature of the authorized person and the seal of the authorized state body for the issuance of foreign passports.

70. In the event of the travel of minor children without accompaniment, in addition to a passport they must have with them a notarially executed consent of the parents or legal representatives upon presentation of documents confirming their rights.

71. It is not permitted to enter children aged 16 years and older in the passports of parents or of the persons in whose company they are travelling.

72. The entry of children in a passport may be effected upon their birth, adoption, or the establishment of guardianship over them by citizens of the Republic of Tajikistan.

73. Where the parents have different citizenship, a minor citizen of the Republic of Tajikistan is entered in the foreign passport of the parent who holds the citizenship of the Republic of Tajikistan. It is prohibited to enter children who are citizens of the Republic of Tajikistan in the documents of accompanying foreign citizens, as well as minor foreign citizens in the foreign passports of parents or legal representatives who are citizens of the Republic of Tajikistan.

74. In the event of the removal of minor children from a passport, the following entry is made therein in the Tajik and English languages: “(Насаб, ном ва соли таваллуди кӯдак) аз шиносномаи мазкур бароварда шуд”, “(Name, last name and date of birth of child) excluded from this passport”. The entry is certified by the signature of the authorized person and the seal of the authorized state body for the issuance of foreign passports.

7. Records of foreign passports and certificates for return, reporting thereon and the procedure for their storage

75. The authorized state bodies keep a record of the issuance of foreign passports in a journal in the following form:

- date of issuance;

- series and number of the passport;

- surname, given name and patronymic of the citizen of the Republic of Tajikistan to whom the passport was issued;

- grounds for the issuance of the passport.

76. The transfer of foreign passports to the Ministry of Foreign Affairs of the Republic of Tajikistan, at diplomatic missions and consular institutions of the Republic of Tajikistan abroad, is formalized by an acceptance-and-transfer act. A report on the expenditure of foreign passport forms is drawn up quarterly and submitted for approval to the Minister of Foreign Affairs of the Republic of Tajikistan. Acts of diplomatic missions and consular institutions of the Republic of Tajikistan abroad are drawn up in two copies, one of which is sent to the Ministry of Foreign Affairs of the Republic of Tajikistan.

77. Diplomatic missions and consular institutions of the Republic of Tajikistan abroad are obliged quarterly to submit to the Ministry of Foreign Affairs of the Republic of Tajikistan reports on the expenditure of forms of foreign passports and certificates for return, the number of extended foreign passports of citizens and the periods of their extension, and the number of spoiled forms, together with the corresponding acts.

78. The procedure and form for the submission of reports by diplomatic missions and consular institutions of the Republic of Tajikistan abroad are established by the Ministry of Foreign Affairs of the Republic of Tajikistan.

79. At the Ministry of Internal Affairs of the Republic of Tajikistan, the acceptance and transfer of foreign passport forms is carried out by an act in the established procedure. Quarterly, at the Ministry of Internal Affairs of the Republic of Tajikistan and its territorial subdivisions, checks are conducted on the state of the recording, storage and expenditure of foreign passport forms, of which acts are drawn up. Acts of territorial subdivisions of the Ministry of Internal Affairs of the Republic of Tajikistan are drawn up in three copies, one of which is sent to the Ministry of Internal Affairs of the Republic of Tajikistan.

80. Information on the issuance of foreign passports containing electronic data carriers is held in established electronic databases. The procedure for their maintenance is determined by a joint Instruction of the Ministry of Foreign Affairs of the Republic of Tajikistan, the Ministry of Internal Affairs of the Republic of Tajikistan and the State Committee for National Security of the Republic of Tajikistan.

81. Forms of foreign passports and certificates for return are stored in specially equipped premises provided for the storage of documents of strict accountability.

82. Spoiled forms are destroyed (burned) pursuant to an act, which is kept in the files of the Ministry of Foreign Affairs of the Republic of Tajikistan, diplomatic missions and consular institutions of the Republic of Tajikistan abroad, the Ministry of Internal Affairs of the Republic of Tajikistan and its territorial subdivisions. The act is drawn up by a commission and approved by the head of the authorized state body for the issuance of foreign passports. Files with acts, upon expiry of the established storage period, are surrendered to the archive of the authorized state bodies for the issuance of foreign passports.

8. Withdrawal and destruction of invalid passports

83. Passports in replacement of which new ones are issued, as well as passports of persons whose citizenship of the Republic of Tajikistan has ceased, and passports of the deceased, are subject to withdrawal and destruction (burning) pursuant to an act, one copy of which is kept in the files of the authorized state bodies for the issuance of foreign passports. Files with acts, upon expiry of the established storage period, are surrendered to the archive of the authorized state bodies for the issuance of foreign passports.

84. The act is drawn up by a commission and approved by the leadership of the authorized state bodies of the Republic of Tajikistan. The destruction of passports is carried out no less than once every six months. The act indicates: the surname, given name and patronymic of the passport holder in alphabetical order, the series and number of the passport, by whom and when it was issued, and for what reason it is being destroyed.

9. Refusal to issue a foreign passport. Withdrawal or cancellation of a foreign passport

85. A citizen of the Republic of Tajikistan may be temporarily refused the issuance of a foreign passport in the following cases, if:

- he is aware of information constituting a State secret — until the expiry of the established period from the moment of termination of the citizen’s access to such information. The said period must not exceed 5 years; it may be extended by a Commission formed by the Government of the Republic of Tajikistan on an individual basis, taking into account a confirmed fact of the citizen’s acquaintance with information constituting a State secret. The classification of information as constituting a State secret is carried out in accordance with the legislation regulating the protection of secret information;

- he has been detained on suspicion of having committed a crime, or has been charged as an accused person — until a decision is rendered in the case or a court judgment enters into legal force;

- he has been convicted of the commission of a crime — until the serving (execution) of the sentence or until release from punishment;

- he evades the performance of obligations imposed on him by a court — until the performance of the obligations;

- he has provided knowingly false information about himself;

- a civil claim has been brought against him in court — until the conclusion of the proceedings in the case;

- he has been recognized by a court judgment as a particularly dangerous recidivist or is under administrative supervision of the militia — until the expungement (removal) of the conviction or the termination of the supervision;

- he has been called up for military service in accordance with the legislation of the Republic of Tajikistan — until the end of military service.

86. The withdrawal or cancellation of a diplomatic or service passport of a citizen of the Republic of Tajikistan may be effected in cases of the institution of a criminal case against him, the termination of his powers as a civil servant, or transfer to other work that does not provide for the right to receive a diplomatic or service passport.

10. Procedure for the issuance and delivery of certificates for return to the Republic of Tajikistan

87. A certificate for return to the Republic of Tajikistan is a temporary document certifying the identity of a citizen of the Republic of Tajikistan and securing his right to return to the Republic of Tajikistan, and is issued for a period of not more than 60 days.

88. A certificate for return is issued by diplomatic missions and consular institutions of the Republic of Tajikistan abroad, and, in the absence of diplomatic missions and consular institutions of the Republic of Tajikistan in a given State, by the Ministry of Foreign Affairs of the Republic of Tajikistan on the basis of:

- an application of the petitioner (Annex 5);

- a certificate of the department of internal affairs or another law-enforcement body of the receiving country of the citizen of the Republic of Tajikistan concerning the fact of that citizen’s application in connection with the loss of the passport;

- a document certifying the identity and belonging of the petitioner to the citizenship of the Republic of Tajikistan (the passport of a citizen of the Republic of Tajikistan, a birth certificate, a military identity card, a serviceman’s identity card, a reserve officer’s military identity card), or written statements, certified by a consular officer in the established procedure, of no fewer than two citizens of the Republic of Tajikistan confirming the petitioner’s belonging to the citizenship of the Republic of Tajikistan, with copies of their passports attached.

In the absence or loss of the passport of a citizen of the Republic of Tajikistan — a copy of the passport of a citizen of the Republic of Tajikistan or of a foreign passport;

- 2 colour photographs measuring 3×4;

- a receipt for payment of the consular fee (if at that institution the issuance of such documents is carried out on a paid basis).

89. Upon the submission of the documents provided for by paragraph 88, a certificate for return is issued without additional coordination.

90. In the absence of the documents provided for by paragraph 88, an authorized employee of a diplomatic mission or consular institution of the Republic of Tajikistan abroad sends a request to the Ministry of Foreign Affairs of the Republic of Tajikistan, or directly to the Ministry of Internal Affairs of the Republic of Tajikistan or its territorial subdivisions, for the establishment of the identity of the petitioner.

91. The Ministry of Internal Affairs of the Republic of Tajikistan and its territorial subdivisions, within 10 calendar days, carry out measures to establish the identity of the petitioner and inform the requesting authorized state body of the results.

92. Diplomatic missions or consular institutions abroad, after determining the petitioner’s belonging to the citizenship of the Republic of Tajikistan, issue certificates for return.

93. The time limit for the consideration of a petition for the issuance of a certificate for return may not exceed 20 calendar days. In necessary cases (additional verification of documents), the time limit for the consideration of the petition may be extended by the head of the diplomatic mission or consular institution of the Republic of Tajikistan abroad for a period of not more than 15 days.

94. A certificate for return is issued only for return to the Republic of Tajikistan and may not serve as a ground for stay abroad. A certificate for return is issued to the petitioner only once until his return to the Homeland.

95. In cases of the impossibility of the return of a citizen of the Republic of Tajikistan within the established period (emergency situations, a serious illness and other cases independent of the citizen), a certificate for return is issued again on the basis of a reasoned application of the citizen with the attachment of the relevant documents.

Annex 1 to the Rules for the issuance of foreign passports containing electronic data carriers
and Certificates for return to the Republic of Tajikistan to citizens of the Republic of Tajikistan

Diplomatic passports are issued to the following persons:

a) the President of the Republic of Tajikistan, the Head of the Executive Office of the President of the Republic of Tajikistan and his deputies, State Advisers to the President of the Republic of Tajikistan, the Head of the Secretariat of the President of the Republic of Tajikistan, senior advisers, advisers, the Press Secretary of the President of the Republic of Tajikistan, Assistants to the President of the Republic of Tajikistan, heads of directorates, heads of departments of the Executive Office of the President of the Republic of Tajikistan, Heads and Chairpersons of bodies under the President of the Republic of Tajikistan;

b) the Chairman of the Majlisi Milli of the Majlisi Oli of the Republic of Tajikistan and the Chairman of the Majlisi Namoyandagon of the Majlisi Oli of the Republic of Tajikistan, a member of the Majlisi Milli and a deputy of the Majlisi Namoyandagon of the Majlisi Oli of the Republic of Tajikistan, the heads of the offices of the Majlisi Milli and the Majlisi Namoyandagon of the Majlisi Oli of the Republic of Tajikistan;

c) the Chairman of the Constitutional Court of the Republic of Tajikistan, the Chairman of the Supreme Court of the Republic of Tajikistan, the Chairman of the Higher Economic Court of the Republic of Tajikistan, the Prosecutor General of the Republic of Tajikistan, the Chairman of the Council of Justice of the Republic of Tajikistan and their deputies;

d) the Prime Minister of the Republic of Tajikistan and his deputies, the Head of the Secretariat of the Prime Minister of the Republic of Tajikistan, ministers and their deputies, chairpersons of state committees and their deputies, chairpersons of committees and agencies under the Government of the Republic of Tajikistan, the Chairman of the National Bank of Tajikistan, the chairpersons of the Gorno-Badakhshan Autonomous Region, the regions and the city of Dushanbe;

e) ambassadors and envoys of the Republic of Tajikistan abroad, employees of the central office of the Ministry of Foreign Affairs of the Republic of Tajikistan, diplomatic missions and consular institutions of the Republic of Tajikistan abroad who hold diplomatic posts, diplomatic couriers;

f) military attachés and their assistants;

g) trade representatives of the Republic of Tajikistan;

h) heads and the diplomatic staff of representative offices of the Republic of Tajikistan in international organizations;

i) academicians of the Academy of Sciences of the Republic of Tajikistan.

j) the spouse and children (adopted children) of the officials mentioned in subparagraphs “a, b, c, d, e, f, g, h, i”, until they reach 23 years of age.

For a private or separate trip of the children (adopted children) of the officials mentioned in subparagraphs “a, b, c, d, e, f, g, h, i”, the corresponding passports are issued to them in accordance with the provisions of these Rules.

Authorization for the issuance of a diplomatic foreign passport is endorsed by the Minister of Foreign Affairs of the Republic of Tajikistan.

The President of the Republic of Tajikistan, the Chairman of the Majlisi Milli of the Majlisi Oli of the Republic of Tajikistan and the Chairman of the Majlisi Namoyandagon of the Majlisi Oli of the Republic of Tajikistan, the Prime Minister of the Republic of Tajikistan and persons holding the rank of Ambassador Extraordinary and Plenipotentiary of the Republic of Tajikistan are issued a diplomatic passport for life.

Service passports are issued to civil servants holding a status of no less than head of a directorate.

Authorization for the issuance of a service foreign passport is endorsed by the Deputy Minister of Foreign Affairs of the Republic of Tajikistan supervising these matters.
