Rules for registration, issuance of visas and electronic visas of the Republic of Tajikistan to foreign citizens and stateless persons

Since 1 January 2017, an electronic system for the issuance and granting of visas to foreign citizens and stateless persons has been in operation at diplomatic missions and consular institutions of the Republic of Tajikistan abroad and at the Main Consular Department of the Ministry of Foreign Affairs of the Republic of Tajikistan.

The purpose of this system is to simplify the procedure for issuing visas of the Republic of Tajikistan, which is another important step in the introduction of electronic public services.

At present, foreign citizens and stateless persons must submit the necessary documents for obtaining a visa at diplomatic missions and consular institutions of the Republic of Tajikistan abroad, as well as for extending a visa at the Main Consular Department of the Ministry of Foreign Affairs of the Republic of Tajikistan, through the web portal www.visa.gov.tj. Depending on the results of the preliminary assessment, applicants will be invited by e-mail to complete the necessary procedures.

It should be emphasized that a request for a Tajik visa issued at the country’s airports upon arrival must also be submitted through the web portal www.visa.gov.tj. As a result of the preliminary assessment, the system sends a confirmation to the applicant, which may be presented, upon request, before departure and at consular offices at airports as a supporting document for obtaining a visa.

To avoid misunderstandings, we inform you that the electronic system for issuing visas of the Republic of Tajikistan is not connected with the “electronic visa” system of the Republic of Tajikistan. As is known, the “electronic visa” system of the Republic of Tajikistan operates at www.evisa.tj. It is a single-entry visa and is issued for a period of up to 90 days, but the visa holder may stay in Tajikistan for no more than 45 days, starting from the date of arrival. An electronic visa is not subject to extension, except in force majeure situations.

In accordance with paragraph 45 of Resolution of the Government of the Republic of Tajikistan No. 31 of 25 January 2017, the period for consideration and issuance of a visa is established at not more than 20 working days from the date of application by a foreign citizen or a stateless person, except in cases provided for by these Rules, and also if, in accordance with the regulatory legal acts of the Republic of Tajikistan and international treaties recognized by the Republic of Tajikistan, a different procedure is not provided. The date of application for the issuance of a visa is counted from the day of submission of all documents provided for in accordance with these Rules. In certain cases the period for consideration of an application for the issuance of a visa may be extended if a more precise examination is necessary, but by not more than 10 working days.

VISA CATEGORIES

Depending on the purpose of entry and stay in the territory of the Republic of Tajikistan, visas are divided into the following categories:

- diplomatic visa of category “D”;

- service visa of category “X”;

- investment visa of category “C”;

- business visa of category “K”;

- work visa of category “M”;

- tourist visa of category “T”;

- study visa of category “O1” and “O2”;

- private visa of category “XC1” and “XC2”;

- free economic zone visa of category “MOI”;

- transport visa of category “H”;

- visa for permanent residence of category “ID”;

- mass media visa of category “J”;

- missionary visa of category “TB”;

- humanitarian visa of category “B”;

- transit visa of category “TR”;

- exit visa of category “Khuruji”.

A visa of category “D” is issued to heads of state, heads of government of foreign states, members of official delegations of foreign states, diplomatic agents of diplomatic missions and consular officials of consular institutions, employees of foreign ministries, diplomatic couriers and foreign consulates, employees of missions of international organizations whose diplomatic status is recognized by the Republic of Tajikistan, observers who, in accordance with agreements ratified by the Republic of Tajikistan, conduct observation in the territory of the Republic of Tajikistan, and family members of the aforementioned persons who hold a diplomatic passport. If the diplomatic status of a foreign citizen who does not hold a diplomatic passport is recognized by the Republic of Tajikistan, a diplomatic visa may be issued to him. If a foreign citizen holds a diplomatic passport but his diplomatic status has not been recognized by the Republic of Tajikistan (in the case of private travel), a visa of another category may be granted to him depending on the purpose of his visit.

A visa of category “X” is issued to members of an official foreign delegation, technical and administrative staff and service staff of diplomatic missions, consular employees and members of the service staff of consular institutions of foreign states, employees of international organizations in the Republic of Tajikistan, persons carrying diplomatic mail but not holding a diplomatic passport, honorary consuls of the Republic of Tajikistan abroad, foreign citizens who have arrived in the Republic of Tajikistan for an official purpose on the instructions of ministries and agencies of a foreign state or at the invitation of ministries and agencies of the Republic of Tajikistan, regardless of the type of their passports, as well as family members of the aforementioned persons.

A visa of category “C” is issued to heads of companies and enterprises who actually participate in investing in the economy of the Republic of Tajikistan, as well as to members of their families.

A visa of category “K” is issued to foreign citizens and stateless persons and members of their families who have visited the Republic of Tajikistan for the following purposes:

a) participation in business negotiations, meetings, symposiums, forums, conferences, tenders, auctions, exhibitions, fairs, cultural and sporting events;

b) for the conclusion of contracts with legal and natural persons of the Republic of Tajikistan, the establishment of joint ventures, the study of the domestic market, the installation, repair and further servicing of equipment, internships, and the provision of consulting services and audit.

A visa of category “M” is issued to foreign citizens and stateless persons travelling to or who have arrived in the Republic of Tajikistan for the purpose of engaging in labour activity, as well as to family members of the listed persons.

A visa of category “T” is issued to a foreign citizen and a stateless person who has visited the Republic of Tajikistan as a tourist.

A visa of category “O1” is issued to foreign citizens and stateless persons travelling to the Republic of Tajikistan for the following purposes:

a) to obtain an education, to enrol in educational institutions implementing educational programmes in the system of secondary education, technical and vocational education, higher education, as well as student exchange programmes and preparatory courses;

b) to study at educational institutions as postgraduate students, doctoral students, and family members of the aforementioned persons.

A visa of category “O2” is issued to foreign citizens and stateless persons intending to arrive for study, the conduct of scientific research, and participation in language courses or advanced training courses.

A visa of category “XC1” is issued to foreign citizens and stateless persons intending to visit the Republic of Tajikistan for treatment, diagnosis, and to visit relatives and friends, and for other private purposes (participation in weddings, funerals and other private events).

A visa of category “XC2” is issued exclusively to former citizens of the Republic of Tajikistan, family members and close relatives of a citizen of the Republic of Tajikistan for temporary stay.
A visa of category “MOI” is issued to foreign citizens and stateless persons engaged in labour, entrepreneurial and commercial activity in the territory of free economic zones.

A visa of category “H” is issued to foreign citizens and stateless persons — drivers of vehicles engaged in international freight and passenger transport.

A visa of category “ID” is issued to foreign citizens and stateless persons who have requested a permit for permanent residence in the Republic of Tajikistan, until the relevant permit is obtained.

A visa of category “J” is issued to correspondents, operators, journalists and other employees of foreign mass media, as well as to family members of the persons specified above, in the event of their accreditation by the Ministry of Foreign Affairs of the Republic of Tajikistan.

A visa of category “TB” is issued to foreign citizens and stateless persons officially registered as employees and conducting their activity or intending to conduct it in religious organizations in the Republic of Tajikistan.

A visa of category “B” is issued to foreign citizens and stateless persons who have brought or are accompanying a cargo of humanitarian aid, or to other persons participating in the provision of humanitarian aid in the Republic of Tajikistan.

A visa of category “TR” is issued to a foreign citizen and stateless persons crossing the territory of the Republic of Tajikistan in transit to the country of destination by air and land transport and is granted for a period of up to 72 hours. A foreign citizen and a stateless person transiting through the airports of the Republic of Tajikistan to third countries do not require a visa if they do not cross the State border through a state border checkpoint. In force majeure circumstances (earthquakes, floods and other cases as a result of which air transport flight is impossible for more than 24 hours), foreign citizens flying to third countries in transit may be evacuated to hotels without a visa until the situation is stabilized. A foreign citizen and a stateless person travelling in transit by land passenger vehicle to the country of destination are issued a transit visa for the period necessary for transit by the shortest route. This period is calculated on the basis of a daily distance travelled by the vehicle equal to 400 km. A transit visa is issued provided that the applicant has a visa of the country to which he is travelling through the territory of the Republic of Tajikistan, or that a visa is not required for travel to the third country. A multiple-entry transit visa is issued if the applicant has a corresponding multiple-entry visa of the state to which he is travelling, or if a visa is not required for travel to the third country.

An exit visa “Khuruji” is issued by the Main Consular Department of the Ministry of Foreign Affairs of the Republic of Tajikistan, and also in exceptional cases by representations of the Ministry of Foreign Affairs of the Republic of Tajikistan in the territory of the Republic of Tajikistan, if a foreign citizen and a stateless person do not leave the territory within the specified period, by a decision of the competent bodies on the undesirable stay of a foreign citizen and a stateless person or on the termination of an employment contract in the Republic of Tajikistan, as well as to foreign citizens and stateless persons who have a permanent place of residence in the Republic of Tajikistan and are departing for permanent residence in other countries. An exit visa is issued for a period not exceeding 7 days. If a foreign citizen and a stateless person do not leave the territory within the specified period for valid reasons, another exit visa is issued to him for a period of up to 3 days. If a person holding an exit visa does not leave the territory of the Republic of Tajikistan within the specified period without valid reasons, his conduct is also considered a violation of the rules of stay in the territory of the Republic of Tajikistan and he shall be administratively expelled beyond the territory of the Republic of Tajikistan. Foreign citizens and stateless persons who have a permanent place of residence in the Republic of Tajikistan and are departing from the Republic of Tajikistan for permanent residence in other countries are issued an exit visa on the basis of the results of a permit of the Passport and Registration Service of the Ministry of Internal Affairs of the Republic of Tajikistan.


TYPES OF VISAS

Visas, depending on type, are divided into:

a) a visa;

b) an electronic visa.


MULTIPLICITY OF A VISA

A single-entry and a multiple-entry visa are issued.

A single-entry visa gives a foreign citizen and a stateless person the right to a single entry into and exit from the Republic of Tajikistan during the period specified in the visa.

A multiple-entry visa gives the right to enter and exit or to exit and enter the Republic of Tajikistan several times (more than 2 times) during the period specified in the visa.

An electronic visa is issued only as a single-entry visa.

Note

Stateless persons, former citizens of the Republic of Tajikistan, have the right to obtain a visa of the Republic of Tajikistan under the simplified procedure.

States not included in the said list may, on the basis of bilateral treaties or mutual visa-free travel between the two states, establish a simplified procedure for obtaining visas.

In order to ensure the rights and freedoms of other citizens, public order, the protection of the foundations of the constitutional order, state security, the defence of the country, public morality, public health and the territorial integrity of the republic, as well as the principle of reciprocity, on the basis of the consent of the Government of the Republic of Tajikistan, the simplified procedure may be temporarily suspended by the Minister of Foreign Affairs of the Republic of Tajikistan.
